NYC Requires Lactation Room Policies to Be Posted

Effective: May 8th, 2025

Effective May 8, 2025, New York City employers with four or more employees will be required to post their lactation accommodation policy in a conspicuous location accessible to all employees. If the employer has an intranet, the policy must also be posted there. This is in addition to the existing requirement to provide the policy upon hire.


Key Updates:

  • Employers must physically post the lactation room policy in a visible workplace location.

  • If applicable, the policy must also be posted on the company’s intranet.

  • The policy must now include New York State’s requirement for:

    • 30-minute paid lactation breaks

    • The ability to use existing paid break or meal time if more time is needed.


The NYC Commission on Human Rights is expected to update its Model Lactation Accommodation Policies before the law takes effect.

Action Item:

By May 8, 2025, update and post your lactation room policy in both your physical workplace and on your intranet, if applicable.

This update stems from Int. No. 892-A, which was signed into law on November 9, 2024.
