Effective August 1st, 2023, Louisiana will require employers with 20 or more employees to provide a single day of unpaid leave for medically necessary genetic testing or preventative cancer screening. Employees can supplement this unpaid leave with any accrued time off they may have. Employers may ask for documentation to prove the testing was completed, but they cannot ask for test results. Employers not operating in Louisiana may still want to pay attention to this legislation. Often, if one state passes legislation, other states are sure to follow eventually. A recent example of this is the Colorado Privacy Act, which followed similar laws passed in California and Virginia.
